ZOEVA PROFESSIONALS PROGRAMM – Allgemeine Geschäftsbedingungen
§ 1 GENERAL
ZOEVA GmbH (hereinafter referred to as “ZOEVA”) is a multinational beauty company that develops, manufactures, and distributes cosmetic products such as make-up. The member of the ZOEVA Professionals Program (hereinafter referred to as “Member”) receives benefits upon proof of eligibility for membership, which are explained in more detail below.
(1) The following general terms and conditions apply to the interaction between ZOEVA and the Member of the ZOEVA Professionals Program regarding (a) the discount granted by ZOEVA to the Member, and (b) the program-related emails that the Member receives from ZOEVA.
(2) By participating in the ZOEVA Professionals Program (hereinafter referred to as the “Program”), the Member agrees to these Terms and Conditions (as amended from time to time).
§ 2 BENEFITS
(1) The Member of the Program is entitled to the following benefits:
a. A 30% discount on all products included in the Program in household quantities, which are available for purchase solely and exclusively by the Member. ZOEVA may change the selection of products included in the Program at any time without the Member’s consent. The Member has no legal entitlement to specific products and/or a specific product range. ZOEVA reserves the right not to fulfill orders if it is proven or suspected (the decision is at ZOEVA’s sole discretion) that resale of products (see §5) is the primary purpose.
b. Emails with exclusive product information.
(2) The exclusive 30% discount can only be used for purchases of products with a minimum order value of EUR 150. The order limit is EUR 1000 per order. ZOEVA reserves the right to change order limits at its own discretion, either generally or on an individual basis.
(3) The exclusive discount is only valid with the registered email address and only through websites operated directly by ZOEVA, including zoevacosmetics.de.
(4) The exclusive 30% discount cannot be combined with other discounts and does not apply to already discounted products, kits, or limited editions.
(5) Discounts do not apply to any shipping costs.
(6) The exclusive 30% discount is only available to the Member. The Member undertakes not to share the discount with third parties.
(7) In the event of a return, the invoiced purchase price will be refunded.
§ 3 ELIGIBILITY FOR MEMBERSHIP
(1) The ZOEVA Professionals membership is available to working make-up artists.
(2) The minimum age for membership is 16 years.
(3) The ZOEVA Professionals membership is only valid for professionals with residence and address in Germany.
(4) Membership is valid for one year. After expiration, the Member must reapply for membership.
(5) To apply for the Program, proof must be provided in the form of the MUA certificate together with a copy of the ID card.
(6) ZOEVA reserves the right to request further proof at any time. All submitted verifications will be stored in the Member’s digital profile and are only visible to our customer service.
(7) ZOEVA has the right to reject the application or exclude the Member from the Program at any time without giving reasons.
(8) A customer account is required for membership.
§ 4 MEMBERSHIP
(1) Membership is free of charge.
(2) Membership is limited to one account per person.
(3) Membership may be revoked by the Member at any time.
(4) ZOEVA reserves the right to revoke membership with immediate effect if the Member is no longer eligible for the Program (e.g., termination of professional activity as a make-up artist, change of business orientation in a manner unacceptable to ZOEVA, etc.).
§ 5 RESALE OF PRODUCTS
(1) Products purchased by the Member with the discount may under no circumstances be sold or passed on to third parties.
(2) If ZOEVA becomes aware that the Member is reselling products, ZOEVA reserves the right to revoke the membership with immediate effect.
§ 6 DATA PROTECTION
(1) Both parties undertake to comply with the applicable data protection regulations, in particular the provisions of the GDPR and the BDSG. ZOEVA is entitled, in particular, to process the Member’s personal data for the purpose of establishing and maintaining membership.
(2) In addition, personal data relating to membership will be stored by ZOEVA. This can be revoked at any time via this contact form.
§ 7 FINAL PROVISIONS
(1) German law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods and international private law.
(2) If the Member is a merchant, Frankfurt am Main shall be the exclusive place of jurisdiction. At its discretion, ZOEVA may also bring an action against the Member at the Member’s place of residence/registered office. For non-merchants, Frankfurt am Main is the place of jurisdiction, provided that the Member relocates their place of residence or habitual residence abroad after the conclusion of the contract, or if their place of residence or habitual residence is unknown at the time claims are asserted in court.
(3) Should individual provisions be wholly or partially contrary to mandatory law, or otherwise invalid or unenforceable, the validity of the remaining provisions shall not be affected.
