Terms and Conditions ZOEVA PR BOX Giveaway
SCOPE OF APPLICATION:
The following Terms & Conditions shall apply to the “ZOEVA PR BOX Giveaway” contest by ZOEVA GmbH, Karl-Ritscher-Anlage 1-3, 60437 Frankfurt (hereafter referred to as “organizer”). By participating in the contest, each participant accepts the following Terms & Conditions.
ELIGIBILITY:
2.1 The ““ZOEVA PR BOX Giveaway” contest is open to any full-aged, legally competent, natural person with residence in one of the organizer’s countries of delivery listed here.
2.2 Minors, legally incompetent persons, employees of the organizer, their relatives and/or those living in the same household are not eligible to participate.
2.3 Unlimited entries per person will be accepted. Each participant has the chance to win once only. Participation through lottery clubs or any other gaming service provider is excluded.
2.4 The organizer reserves the right to exclude persons from participation who violate these Terms & Conditions or get or want to get an unfair advantage over other participants through undue influence or manipulation of the contest. In these cases, participants can subsequently be excluded from the contest; prizes can be denied and reclaimed by the organizer.
2.5 The following requirements must be met to participate in the contest:
The participant needs to follow @zoevacosmetics on TikTok
The participant needs to like the ZOEVA TikTok post, posted on November 3rd, 2022;
The participant needs to tag one friend in the comment section of the ZOEVA TikTok post, posted on November 3rd, 2022
2.6 The participation is free of charge and not subject to the purchase of a product or service. The purchase of a product or service does not increase the chance of winning. Naturally, however, participation in the competition results in the usual costs for Internet use, whether by landline, mobile phone or other means, which are to be paid to your network operator as usual. These costs can be considerable, especially for Internet visits with mobile devices, unless a flat-rate tariff has been agreed. For the sake of completeness, we would like to point out these costs to be borne by the participant.
HOW TO ENTER:
3.1 The contest starts on Thursday, November 3rd, 2022 at 12:00 PM CET and ends on Sunday, November 6th, 2022 at 23:59 PM CET.
3.2 One winner will receive the following prizes:
1x ZOEVA PR BOX SOFT VEGAN PERFORMANCE BRUSHES (includes 9 brushes)
3.1 Winner will be determined by a random, non-public draw. All participants who fulfill the requirements as per clause 2.5 by the entry deadline will be considered. The draw will be executed by the organizer’s employees. There is no right of appeal.
WINNER SELECTION AND NOTIFICATION:
4.1 The Winner will be informed via TikTok direct message about their prize by Monday, November 7th, 2022. The participant who has received such a direct message, is required to inform the organizer within one month after the message was sent, whether he/she wants to accept the prize. The possibility to accept the prize expires, in case the organizer does not receive the respective message within this period.
4.2 Any claim to the prize does also expire, in case the prize cannot be submitted to the winner within 6 months after the first notification of the win for reasons attributable to the winner.
4.3 The prize will be sent to the winner by standard mail to his postal address. The organizer shall bear any reasonable costs arising from the shipment of the prize.
4.4 The risk of accidental loss of the goods passes to the respective winner when the respective prize is handed over to the Post. The organizer is not responsible for delivery damages.
4.5 Cash payment of the value of the prize or any other substitution of the prize are excluded. The prize is non-transferable.
PREMATURE TERMINATION OF THE CONTEST
5.1 The organizer has the right to prematurely terminate the contest at any time without notice and without giving reasons. This applies in particular, if a proper execution of the contest cannot be guaranteed for technical or legal reasons.
5.2 The organizer also reserves the right to change these conditions without prior notice.
DATA PROTECTION
6.1 To accept the prize, the following personal data of the selected winner needs to be provided: first name, last name, mailing address. The selected winner confirms that all data provided is correct.
6.2 Personal information pertaining to the participant will be gathered, processed and saved by the organizer for the execution of the contest only and will neither be passed on to third parties nor ceded for their use without the agreement of the participant.
6.3 The participant revocably agrees that, in the event of a win, his/her Instagram name will be referred to on the organizer’s Instagram presence (Instagram Story).
6.4 The data processing is based on the participants consent, article 6 (1) (a) GDPR. The participant has the right to withdraw consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal.
6.5 For all other issues, reference is made to the organizer’s privacy policy.

In accordance with article 13 of the German Data Protection Regulation (DSGVO), we would like to inform you which data we collect in the context of competitions on our social media channels [Instagram, Facebook, Twitter, LinkedIn, Xing, Pinterest and YouTube] and how we process it in the following.

Processing purposes and legal basis: The purpose of the data processing is the implementation of the competition.
Unless otherwise specified in the respective competition or unless you have given us further express consent, the personal data you pass on to us as part of your participation in the competition will be use exclusively for the purpose of processing the competition (e.g. determining the winner, notifying the winner, sending the prize). The legal basis for the described data processing is generally article 6 paragraph 1 lit. b DSGVO. In the event that a declaration of consent is submitted in the contextof a competition, article 6 para. 1 lit. a DS-GVO is the legal basis for the data processing based on the consent.
Data categories and data origin: In the event of a competition on our social media channels, we generally process the following data:
- Public profile information including username
- Submitted comments (text & image)
We request the following data from winners as part of the competitions:
- Name, first name
- Address details
- E-mail address, if applicable
Recipients:
We do not pass on your personal data to unauthorised third parties without your express consent. Your data will only be passed on or transmitted to the extent necessary for the processing of the contract, e.g. for the purpose of prize delivery by a shipping service provider.
If other external service providers support us [e.g. for determining the prize or carrying out the competition], this is done within the framework of order processing in accordance with article 28 DS-GVO.
We only conclude contracts with service providers that offer sufficient guarantees that appropriate technical and organisational measures ensure the protection of your data.
Data transfer to a third country: Data transfer to third countries does not take place and is not intended.
Duration of storage: After the end of the competition, the participants' personal data will be deleted after a maximum of 30 days, provided that there are no further legal retentionperiods.
Rights of the data subject: You may at any time request information about the data we have stored about you, or request that we correct, block (restrict the processing of) or delete your stored data and the processing thereof. If legal, contractual or commercial or tax retention periods or other legal reasons prevent deletion, your data will not be deleted but blocked. Furthermore, you have the right to data portability in a structured, common format.

Right to complain to the supervisory authority: Pursuant to article 77 DS-GVO, you have the right to complain to the supervisory authority if you believe that the processing of your personal data is not lawful.

APPLICABLE LAW
All legal relationships of the parties are subject to the laws of the Federal Republic of Germany. For consumers, this legal choice is valid in as much as the granted protection is not withdrawn through compulsory regulations of the law of the state in which the customer is usually resident.
